Disclaimer and Indemnity Agreement
Disclaimer
By participating in any activities or services offered by Precious Moments Safaris, all guests acknowledge and accept the inherent risks associated with wildlife safaris and outdoor activities. Guests understand that wildlife encounters, transportation, and certain activities may involve unpredictable conditions and potential dangers. Precious Moments Safaris will take all necessary precautions to ensure the safety and well-being of its guests; however, guests participate at their own risk.
Assumption of Risk
Guests understand and acknowledge that there are inherent risks involved in wildlife safaris, including but not limited to: encounters with wild animals, weather conditions, terrain challenges, and transportation-related risks. Guests voluntarily assume all risks associated with their participation in these activities and agree to act responsibly and follow all instructions provided by Precious Moments Safaris' staff.
Indemnity
In consideration of being permitted to participate in activities organized by Precious Moments Safaris, guests agree to indemnify and hold harmless Precious Moments Safaris, its owners, employees, agents, and affiliates from any and all liabilities, claims, expenses, theft, damages, and losses, including but not limited to legal fees, arising from guest's participation in the safari activities, except in cases of proven wilful misconduct or gross negligence on the part of Precious Moments Safaris.
Limitation of Liability
Precious Moments Safaris shall not be liable for any personal injury, theft, loss, damage, or expense incurred by guests during the safari, except where such injury, loss, damage, or expense arises as a direct result of proven wilful misconduct or gross negligence on the part of Precious Moments Safaris.
AGREEMENT
By engaging in any activities organized by Precious Moments Safaris, guests signify their understanding and agreement to be bound by this Disclaimer and Indemnity Agreement.
